PROTECTION OF CHILDHOOD
Regarding positions of violence against children and adolescents, the governing body of the Canarian judges requests the creation of a new judicial position in the instruction section of the Court of Instance of Las Palmas de Gran Canaria and, simultaneously, «the creation of a section of violence against children and adolescents in the mentioned Court, which extends its jurisdiction to the entire island of Gran Canaria, a section integrated by a single judicial position that will come from the transformation of the judicial position number 3 of the instruction section.»
The Court also proposes the creation of a new section of violence against children and adolescents, equipped with a new judicial position, which extends its jurisdiction to the entire island of Tenerife «in the Court of Instance of Santa Cruz de Tenerife or in that of San Cristóbal de La Laguna», and emphasizes that this section should be «provided with the means available to the current Court of Instruction Number 3 of Las Palmas de Gran Canaria».
Furthermore, it requests that once the section of violence against women is established in the Court of Instance of Arrecife, it is agreed that the knowledge of matters related to violence against children and adolescents «correspond to one of the positions of the instruction section, exclusively but not exclusively.»
The Court understands that, once the separation of jurisdictions in Puerto del Rosario is approved and the section of violence against women in its Court of Instance is established, it is agreed that the knowledge of matters related to violence against children and adolescents «correspond to one of the positions of the instruction section, exclusively but not exclusively.»
For the island of La Palma, the Court proposes that, both for the judicial district of Santa Cruz and that of Los Llanos de Aridane, the knowledge of matters related to violence against children and adolescents correspond exclusively but not exclusively to the judicial position that already has the knowledge, also exclusively but not exclusively, of matters related to violence against women.
CRITICAL SITUATION IN TENERIFE
The governing body of the Canarian judges presents to the CGPJ, the Ministry of Justice and the Government of the Canary Islands a series of «common needs» in the field of violence against women and violence against children and adolescents that affect the judicial districts of the territory, and agrees to request from the Government of the Canary Islands, «as a service-providing administration,» the adaptation of judicial offices and an increase in personnel, if necessary, «for the proper attention of the new sections and positions in these matters»; the adoption of measures to avoid the confrontation of victim and aggressor in the judicial setting, and the provision of «adequate facilities for the offices that serve the sections and positions established in these matters.»
It emphasizes the need to provide resources to the headquarters of the courts for violence against women in Santa Cruz de Tenerife, whose situation, the governing body emphasizes, is «especially deficient and serious.»
In this regard, it emphasizes, «action must be taken immediately.»
The Court also calls for the creation of victim support offices and the provision of psychosocial teams for the «immediate and preferential» attention to these matters, the adoption of the necessary measures to facilitate transportation for transfer to another judicial district «in cases of regionalization,» and, in general, «the urgent adoption of measures to provide all courts with the necessary means for prompt and specialized attention to these matters.»
The agreement of the Court of Government concludes by directing a communication to the Ministry of Justice «so that it proceeds to allocate positions of court clerks for the new sections and positions requested.»
