The reported incidents occurred since the victim, now of legal age, was three years old
The sixth section of the Provincial Court of Santa Cruz de Tenerife has scheduled the trial against the accused for sexual assault on his then underage stepdaughter for this Tuesday. The Prosecutor’s Office is asking for 12 years in prison and ten years of supervised release. The reported incidents date back to when the minor was three years old.
The accused is also requested to have a ten-year restraining order and to pay a compensation of 600,000 euros to the victim.
The Prosecutor’s Office states in the complaint that the accused lived with the victim, born in 2006 and the daughter of his ex-partner, since she was a baby, making him «the only father figure the minor has known.»
The document continues by alleging that taking advantage of this situation, the accused allegedly subjected the minor to various sexual practices, as well as other lascivious behaviors such as kissing on the mouth, obscene and controlling comments, until the victim filed a complaint on March 3, 2024.
According to the victim, the abuse began when she was 3 years old.
As a result of the reported incidents, the victim has experienced «low self-esteem, anxious and depressive symptoms since childhood,» with self-destructive behaviors and suicidal ideation, which have also affected her studies and interpersonal relationships.
Additionally, the minor was diagnosed with «vaginitis and unspecified vulvovaginitis» in October 2010, and again with vaginitis in June 2017, experiencing several episodes of vomiting and tachycardia.
The accused is currently in provisional prison without bail pursuant to the order of March 8, 2024, issued by the Court of Instruction No. 4 of Santa Cruz de Tenerife, ratified by the Court of Instruction No. 2 of Santa Cruz de Tenerife by order of March 14, 2024.
